Bismarck, ND(KEYZ) There’s a new prosecutor in the case against suspended McKenzie County Sheriff Gary Schwartzenberger’s and his removal proceedings, and related credit card misuse charges. This after, William O’Driscoll, the special prosecutor withdrew from the case last week writing that the proceedings against Schwartzenberger are “not appropriate.”
Following O’Driscoll’s April 6 withdrawal letter to Gov. Doug Burgum, Assistant Attorney General Michael Mahoney was tagged replacement prosecutor. Mahoney says he’s ready to proceed and if approved, the hearings could pick up as soon as Monday April 24.
O’Driscoll in his letter of withdrawal had suggested to the Governor that mediation specialists be brought in to work with all county officials not just the suspended Sheriff, for the betterment of the county. O’Drisoll letter ended with a stark conclusion that the burden proof to remove Sheriff Schwartzenberger “cannot be met and (his) removal is not appropriate.”
